Mediation
I am convinced that every effort should be made to help clients
resolve disputes early and in a cost-effective manner.  So, I support
mediation and arbitration, where appropriate.  A brief resume of my
arbitration and mediation experiences follows:


Experience         Active practice of law since 1978. As a lawyer,
practice in areas of energy and commercial law, litigating a wide
variety of cases before juries, judges, and administrative agencies.  
Half of practice in commercial law representing oil and gas concerns,
contractors, construction companies, and individuals.  Other practice
areas include real estate, international negotiations, commercial
negotiations, employment law, and state and federal taxes.  Served
as impartial judge in utility rate cases and state tax disputes.  

Representative Case
Handled As a Mediator   
    Recent case concerned construction
dispute in Pennsylvania.  Contractor had been engaged to do a soil
analysis of potential site for a state prison.  Because the land had
been extensively mined, extensive tests were required, resulting in a
significant over-run from original, projected costs.  Mediation, which
took approximately 5-hrs, resulted in the settlement of a contract
dispute in excess of $100,000.  Parties have had successful,
subsequent ventures.

       Certificated Mediator since 1995.  As
mediator, settled cases ranging from less than $10,000 to more than
$1 million.  State Tax Judge (Texas); Administrative Law Judge [Utility
Rates] (Arkansas).
